Three judges sitting on the panel of the 6th Circuit Court of Appeals in Cincinnati said the same federal laws currently in place to halt music piracy will also apply to digital sampling, and explained, “If you cannot pirate the whole sound recording, can you ‘lift’ or ‘sample’ something less than the whole? Our answer to that question is in the negative.”
I know people (myself included) tend to associate “sampling” with rap/hip-hop, but how will this impact music in general? Is it a good thing, a bad thing? Is there something inherently right or wrong with directly lifting someone else’s music and using it as your own?
Keep in mind that this is just a 6th Circuit ruling and is subject to being overturned but I figured it might get people talking.
